Two would-be burglars got more than they bargained for Sunday morning — including a trip to the hospital for one — after the owner of the Vacaville home they allegedly broke into greeted them with a gun.

Around 8:20 a.m., Vacaville police dispatchers began receiving 911 calls reporting gunshots near the 100 block of Marna Drive, including a call from Jamie Aguirre, who said he had just shot an intruder in his home.

Aguirre, 38, “voluntarily disabled the weapon” and complied with officers as soon as they arrived, police said. He told officers three men had barged into his home and began threatening to assault him. Aguirre said he kept his distance and repeatedly told them to leave his home. Despite his pleas, one of the men, later identified as 21-year-old DeJohn Miller, moved in closer to Aguirre, who fired a single shot from a handgun at him, striking him in the lower stomach, police said.

The three men sped away from the area in a white Mercedes. Miller, who police said suffered a “non-life-threatening” gunshot wound that passed “through and through,” was dropped off at a local hospital, where he underwent surgery.

As of Monday, he remained hospitalized.

Kevin Fonseca, 20, of Sacramento, was arrested at the hospital on suspicion of a variety of crimes, including making threats, trespassing and burglary, police said. Authorities said they are seeking charges against Miller, who was shot. The third person, who is also in his early 20s, was not arrested.

Sgt. Jeff King said all of the people involved in the case knew each other and the incident, which “is not gang-related” or “a threat to public safety,” is part of “an ongoing dispute.”

King said investigators have determined that Aguirre”s actions were lawful and that he acted out of fear for his safety, adding, “The people who entered the home did so with the intention of making threats to do bodily harm.”

The investigation is “ongoing,” King said, and anyone with information is asked to call the Vacaville Police at 449-5200.
